Bad Credit Repair Forces Florida Man To Fight Aggressive Debt Collector!

Dennis Z., Orlando (FL), is tired of fighting NCO Financial, a debt collector.

NCO Financial, Dennis claims, CONTINUES contacting him about a debt he does NOT owe.

Dennis claims he has sent proof by certified mail to NCO Financial he does not owe the debt, as NCO Financial simply ignores his proof.

Frustrated, Dennis contacted me with the following email asking for help.

I am not an attorney, so I do not dispense legal advice. Only from years of experience do I offer suggestions.

In many (most) cases, debt collectors including NCO Financial gamble that YOU (and Dennis) know nothing about (your) consumer rights.

They gamble and win, knowing they can beat you over the head and squeeze money out of you…without validating the debt…without breaking down the alleged debt….

They KNOW they can illegally re-age this alleged debt and you will pay.

They KNOW they can threaten you…call you at work when you and/or your manager have told them not to call…and even call your neighbors and family and embarrass you by giving out details.

They KNOW they can get away with violating your rights and FORCING you to pay.

DEBT COLLECTOR PICKS ON WRONG GUY!

As you read Dennis’ email, consider that NCO Financial (and other debt collectors) regularly hit the Federal Trade Commission’s and various State Attorney Generals’ “Most Wanted” list. NCO Financial has been sued and fined for violating consumer reporting violations.

Dennis says:

“Can you please help me? For weeks, debt collectors from a company called NCO Financial have been leaving threatening voice mail messages demanding I pay a $4,200 delinquent student loan they allege I owe from 2004.

I owe nothing. I paid my student loan off in 2008. I have faxed and sent them by certified mail my payoff letter that shows zero balance. What more can I do?

I’m getting about 4-5 calls a day at home always b/t 10-12 PM.

Now they’re calling me at work, even though my boss has told them no personal calls at work.

These debt collectors, who sound like they’re from a different country, try to threaten me on the phone with arrest and lawsuit. I have many voice recordings from these debt collectors threatening me.

They told me they will garnish my wages if I don’t send wire them full balance this afternoon. To my shock, they’re calling my Mom & Dad, who know my student loans are paid off. The other day, one of them called my Dad’s number and told him about my loan.

Making this worse, they are reporting me to the credit reporting agencies, and my credit score has dropped 90 points. I am so angry, but I don’t know what else to do. My Mom & Dad tell me to hire a lawyer.

Please help, Mike. I have become a regular reader of your blog and I tell all the people I know about your blog. I appreciate any help you can offer.”

NCO Financial Violations Fill A Kitchen Sink

It appears NCO Financial has committed several state & federal violations of Fair Debt Collections Practices Act (FDCPA).

Dennis has 2 options:

  1. Contact an experienced FDCPA attorney with www.naca.net. Consider an attorney who works on contingency – that is, she/he gets paid by the DEBT COLLECTOR when you win your case or settle outside of court.
  2. Hit NCO Financial across the head with FACTS suggesting violations, demanding that NCO Financial DELETE the bad credit listing from every credit reporting agency reporting and that you receive a copy of the letter. Demand NCO Financial state in writing they NEVER will call you again or attempt to collect on this alleged debt. You want your demands clearly spelled out and signed by an officer with NCO Financial.

Personally, I’m of the opinion every debt collector abusing your rights should be exposed in a court of law and forced to PAY for your pain & suffering and (at the least) all your attorney’s fees. Unfortunately, I personally know you can be 1,000% right in your legal position and still not be guaranteed to feel whole even after winning in court. In my younger years, I brought many suits out of real financial loss and principle. I learned quickly that you can win in court and still lose.

there is nothing a credit repair company can do to improve your credit that you can’t do for yourself. So, save yourself some money and the hassle of finding a reputable company and repair your credit yourself.

@Florida Lemon Law – typically I trash all comments similar to yours as spam (link baiting). I kept your comment simply to make a point – the “right” credit repair company/individual CAN do much more than any one (uninformed) person can do. On the surface, your comments (which you pulled off the Federal Trade Commission website) are true. However, most people I encounter do NOT want to make time to learn how to address their credit issues. They’d rather whip out their wallets & pay someone/some company.

I *wish* I could find just one – even one – legitimate, effective & affordable credit repair company. For around 20 years, I have searched for even one credit repair company and spent my own money testing various credit repair companies.

I do NOT fix people’s credit for them. I want to find a legitimate, affordable & effective credit repair company to help the people who do not want to take time to learn how to help themselves. For now, I cannot recommend even one credit repair company.

Daily, I hear from people who paid and paid and paid monthly to a credit DISrepair company, only to watch their scores drop or (worse) get sued. ONLY then did they contact me for advice.
