Bad credit repair has hit over 113 MILLION people now! Every day, countless people lose their jobs, unable to feed their families. Last month, employers threw pink slips to over 700 THOUSAND people!  …700,000 people! WTF! These hard-working people who did nothing wrong are losing their jobs, losing their homes, losing their hope & flat out LOSING!

I wish I felt differently. I wish I could sugar-coat what I see and hear and feel.

According to housing “experts,” the “stimulus” package will only “stimulate” the FAT-CATS…so that they can line their pockets with taxpayer money even more than they already have.

Goddammit, this crap has to stop. What is it going to take? …riots? …Americans storming the gates of these palatial Mcmansions owned by these greedy CEOs stealing taxpayer money?

Is that what it’s going to take?

Speaking of what is it going to take.

Last Saturday, a lady named Emily (?) emailed me, begging for my help.

According to Emily, this same debt collector keeps calling her about her sister’s car loan in default.

Emily claims this debt collector is threatening to have Emily arrested if she doesn’t pay her sister’s debt and tell the debt collector how to get in touch with Emily’s sister.

According to Emily, the debt collector states he knows where Emily lives and will keep “on her” until she gives him what he wants.

Repeatedly, Emily claims this debt collector calls her a “b*tch”….screaming and threatening her, calling 3-4 times a day.

What should Emily do?

If what Emily is saying is true, here’s a debt collector who needs to be hung by his privates…and left to rot! Enough said.

STRING HIM UP…IT WILL TEACH HIM A LESSON!

Right now, we’re “assuming” Emily is telling us the truth about an alleged debt collector’s out-of-control behavior. If true (and I have no reason not to believe Emily as many, many others have tape-recorded this kind of behavior from debt collectors), this debt collector’s ILLEGAL behavior must be stopped…immediately!

  1. Emily, did you co-sign for your sister’s car? If so, you are responsible for payments. If no payments are made, you (as well as your sister) will suffer.

…if the debt is legitimate.

Yes, your credit will suffer…chances are, you will get hit with a judgment (if/when the owner of the debt sues you), which will haunt your credit for years.

If you have assets, a bank account and/or a job, the judgment creditor can request the Court force you to sign an affidavit listing all assets, bank accounts, income etc.

At which time, the judgment creditor can LEVY your bank account and/or GARNISH your wages according to the legal limits for the state in which you live.

  1. Emily, do not take any other phone calls from this debt collector. Get a recorder and turn calls to voicemail. Chances are, this debt collector uses an auto-dialer and unlisted number (probably ending is all zeroes or some other bizarre number). Right?
  2. A debt collector CANNOT, I repeat CANNOT, have you put in jail.
  3. A debt collector is not allowed by law to threaten you in any way…not even allowed to hint at legal action or threaten you with legal action.
  4. A debt collector CANNOT harass you. Clearly, you are being harassed.
  5. File a police report and complaint with your State Attorney General’s office…if you know the name of this debt collection company. Again, if this debt collector is behaving as alleged, Emily may not even know the name of the debt collection company.

Do not take this debt collector’s calls. Do not allow a debt collector to harass and intimidate you. Do not get angry or upset. Instead, pull all three copies of your credit reports to confirm the listing and who’s reporting this account (which debt collection company?).

I’m assuming you co-signed for your sister. Though debt collectors certainly are known for harassing family members, trying to get family members to succumb to harassment.

You must be prepared for legal action, perhaps a suit summoning you to court. If so, please get an attorney to represent you either by going to www.naca.net or Legal Aid if you cannot afford an attorney.

You must respond to the Summons and appear in court if sued, or the debt collect wins by default.

Bad credit repair and harassment have gotten more scary than today’s economy. Making the wrong move today can be deadly. Document everything. If I hear back from Emily, I will update you. In the meantime, please share your experience with a debt collector. I pray you’ve not experienced a nasty, power-hungry, crazed debt collector. They most certainly are out there.
