Credit Law Repair doesn’t need to get all “legal-speak” on you. This is not rocket science. It isn’t complicated! So don’t worry. What you’ll discover is that many “items” on your reports are easier to dispute and have removed (if that’s what is best) than others (see list below).
Earning good credit is more about understanding your state’s laws than it is about Fair Credit Reporting Act (FCRA) and Fair Debt Collection Practices Act (FDCPA).
Really!
So don’t worry about all these acronyms such as FCRA, FACT, FDCPA, etc.
As I’ve mentioned before, it’s more important for you to get familiar with your state’s Statute of Limitations, in particular.
Unfortunately, there is lots of misinformation on the web about NEW RIGHTS under the 2003 FCRA amendment (in particular, the FACT Act) and many credit sites recommend disputing with creditors directly.
Not so…you dispute with the BIG 3 first…as you ‘cherry-pick’ the list below for easy “deletions.”
THE CHERRY-PICKING SECRET FOR GRABBING POINTS
Many credit repair companies also send frivolous disputes directly to CREDITORS. Of course the credit repair mills don’t send disputes with the intent to sue because the disputes are frivolous and they try to delay corrections so that good people like you continue to pay longer for services you’re not receiving.
However, you are NOT sending frivolous disputes and you know what is an appropriate dispute.
And for heaven’s sake, do NOT demand validation from your creditors if you know a bad credit account on your reports is “not yours.”
If it’s NOT your account, send a notarized fraud affidavit. Demanding validation suggests you’re a liar or you don’t know what you’re doing.
You DO know what you’re doing, especially on easier items to dispute and have removed.
Easier Items To Dispute And Have Removed:
* Items older than 2 years
* Discharged bankruptcies
* Charge-offs
* Inquiries
* Repossessions
* Late payments
* Accounts that were late but are now paid off
The reason these items are easier to remove is simple; when you dispute an older account or an item that is now charged off, the creditor is not too concerned with the account any more. They may not even be able to find the necessary information to verify the dispute.
Even if the account was once seriously past due, but now is paid off, creditors usually will not take the time to verify the dispute since they have already been paid.
More Difficult Items To Dispute And Have Removed:
* Accounts that are currently past due
* Recent Bankruptcies
* Judgments
* IRS or State Tax Liens
* Current collection accounts
These are more difficult because creditors keep these types of accounts in their current files and they are expecting you to pay them. That is why it will be much easier for them to verify the information and keep the item on your credit file. However, it is always worth a try.
Important: It is completely legal for you to dispute items on your credit file even if you know they are correct. You are simply testing to see if your creditors have maintained the proper records to verify the dispute. You have a very bad memory and forgot that the negative accounts on your credit file are really yours.
Credit Law Repair requires the Credit Bureaus verify all disputes. If they are unable to verify your dispute, the law says these non-verified accounts must be removed from your file.
In my videos and book, “The Busy Person’s Credit Makeover,” I show you how to “mine for deletions” without (and this is important to understand) always expecting deletions. You see, on some accounts you do NOT want a deletion. This is what is meant by “strategic” credit law repair.
