“My credit check upset me so much I ate a whole Oreo 31 Below Pie…all by myself!. That’s how upset I was when I saw my scores,” writes Sandy T, Colorado Springs, CO

“I paid off a judgment and it’s still showing up as unpaid with a balanced owed,” adds Sandy.

Question: “How do I get a paid judgment off my reports? It’s paid off, I can prove it’s paid off.”

Response: Daily, I receive tons of questions similar to Sandy’s.

Obviously, I’m not an attorney and I don’t play one on TV, but I do think playing in cake looks fun :-)

Sorry about that, my excitement got the best of me for just a moment. :-)
Now, please hear this: the Fair Credit Reporting Act [FCRA 1681c(a)(2)] requires the following information be left off your credit reports: “Civil suits, civil judgments, and records of arrest that from date of entry, antedate the report by more than seven years or until the governing statute of limitations has expired, whichever is the longer period”.

By the way, the date of entry is the filing date, without regard to whether or not the judgment is satisfied:

  1. Is this judgment listed as ‘satisfied’ on your credit report?
  2. Does it show a balance owed?

Is it satisfied? Does it show a balance? Which one (or both) exists? It doesn’t matter, if either is incorrect.

Clearly, the judgment at best should be reported as “Satisfied.”

Next, go online to your County’s Clerk of the Court’s website and check the public records to confirm this judgment you’ve paid is marked as “Satisfied.”

If not, call the attorney for the judgment creditor and inform the attorney he/she needs to file the “Satisfaction.” While you’re at it, request a certified copy for your records.

Report 100% Accurately or Delete!

The attorney might not file the “Satisfaction,” in which case you should file a dispute. You see, it’s simple…either your every account on your reports is 100% accurate or it’s deleted. Further, it’s not your job to convince the Big 3 this account is inaccurately reported.

Send your dispute certified mail, return receipt requested (CMRRR). Yes, CMRRR costs a couple bucks but you need to pay the money to prove you have mailed it, just in case they try to get you to go away.

As you’ve heard me say, my credit check shocked me once as well..actually more than once. The shock wears off, so you don’t need to stuff yourself with a whole Baskin Robbins Oreo 31 Below pie! For heaven’s sake, next time at least save a piece for me :-)
