  2. Why are you even bothered by a 17-year-old collection?

Desiree claims to get phone calls “…everyday by two collection agencies, I still have not spoken to anybody as they are automated calls.”

Oh, okay, I get it now. When Desiree mentioned the phone calls from debt collectors on a 17-year-old debt, I knew exactly what was going on. And to think, Desiree was ready to throw away $1,346.85. How happy do you think Desiree was when I handed her the answer on a silver platter?

Now for the rest of this story.

Desiree’s email informed me “there are 3 credit cards that were turned over at least 17 years ago. They are all offering reduced payment of which I could afford to pay with the reduced settlements.”

Big surprise! Another debt collector picks up a list of “zombie” debt and launches a little “dialing for dollars” attack.

Desiree was reluctant to pay anything but then the debt collector mentioned reduced settlement and threatened her with imprisonment, public humiliation & job loss.

Let’s get a couple points clear right now:

  1. It’s illegal for a debt collector to threaten you…period!
  2. You will not go to prison for owing a debt…period!
  3. You will not lose your job for owing a debt (even if it’s a collection)…period!
  4. You cannot face any public humiliation due to a collection…period!

Further, Desiree indicated that she “…know(s) they are trained to get information from me and I am not skilled enough to figure out if I am putting myself back in to a position of getting these accounts off my reports.”

  1. And then Desiree said the words that make all debt collectors blush with pride, “I’m going to take their settlement offer and pay them $1,346.85 just to get them off my back.”

And this is exactly what debt collectors want to hear.

Without hesitation, I emailed Desiree suggesting she reconsider paying this debt collector.

Here’s part of what I emailed Desiree:

  1. Every state has special laws outlining debt collection (I emailed Desiree the exact info from my videos and book The Busy Person’s Credit Makeover to be wise about this debt collection attempt). That law requires a creditor to file any legal actions within a specified period of time, or else they forfeit their right to collect. Clearly, this debt appears to be “time barred.”
  2. If so, DO NOT pay them a dime.
  3. If so, DO NOT talk to them on the phone.
  4. Send them a certified letter (certified mail return receipt requested) stating that the debt is beyond the statutes of limitations and they can no longer contact you by phone or by mail. This is a “cease and desist” statement, and if they contact you again you will file complaint with the FTC and your state’s attorney general.
  5. Do not talk with the debt collector; do not suggest, say or sign anything promises payment, even a penny. If you do, you might reset statute of limitations.

A couple days later, Desiree’s email reminded me just how much I enjoy what I do to help people keep from throwing $1,346.85 away and putting up with a debt collector’s threats and non-stop phone calls.
