Gena,

I hope your attorney is a pitbull who is looking for violations committed by this debt collector. My experience is that even attorneys attached to NACA (@ www.naca.net) must be interviewed. Some claim to be FDCPA "experts" but they're not. You absolutely do not want someone going through the motions. What do you know of a "friendly judgment?" At some point, I need to get a friend on the phone for a recording of how to utilize this strategy for "decommissioning" debt collectors.

Please keep me updated, Gina. I presume your attorney is examining your state's debt collection licensing laws; whether the debt collector is legally permitted to pursue collections on this debt; & what settlement can be arranged outside of court (to minimize legal expenses).

I have been dealing with debt collectors for over a year now. I am currently getting ready to go to court with one that is sueing me, but they are a 3rd party debt collector and don't have the right. I have been screamed at repeatedly and most of the time I don't even answer the phone. Now I have to pay an attorney $1,500 to go to court for me, so that I won't end up being garnished for $15,000!
