Stop debt collectors, especially nasty debt collectors, from harassing and intimidating you. To get debt collectors off your back, you must discover your rights and stand up to debt collectors — with NO fear or intimidation.

Another nasty debt collector is flexing his/her wimpy muscles, trying to instill fear in people UNINFORMED about their rights.

The other day, a lady named Maria Muniz emailed me, asking me to help her. I could hear the fear and desperation in her words.

  • Debt collectors CANNOT harass, threaten or otherwise abuse you.
  • Debt collectors CANNOT “claim” they’ll garnish your wages, seize your property, put you in jail, or threaten to take your personal property without a judgment.
  • Debt collectors CANNOT cash a post-dated check, cost you money by making you accept collect calls or COD mail (see image below).

What are the consequences of not paying your credit cards?

i recently received a phone call from a collection agency who informed me that i owe them close to $4,500.00 to citibank.

they were just asking me all kinds of questions like -- how come you have not respond to us?what is your address? where do you work? how much do you make? how come you are unable to pay? Shocked and scared i told them my address (new address and place of employment) and how much i made.

i also told them i only work part time and i am a student and that i have other bills to pay. then i was transferred to another representative and he just started bashing me putting me down saying- you owe us this and that and you need to take responsibilities for you actions.

i told them i tried to because i had agree to settle with citibank a year ago to make monthly payments by which they debit the money from the bank. they stopped after several months and now out of nowhere this collection company calls me. the guy said they need the money from me, paid in full, by the next day.

i told them i have no money for them. they said you owe us money and you need to find ppl that can help you.we need the money [or else they said they will have to inform citibank to take further actions against me.] (my emphasis added) what  further actions? (will i have to appear in court? are they going to sue me? can i get arrested? will they try to get of hold of my workplace and garnish my wages?)

i told them ill try my best to have it by the next day which i don’t. help!

For Maria and anyone else faced with (nasty) debt collectors, you have the right NOT to take their calls and to tell debt collectors in WRITING that you do not want them calling you at home, work or at friends, family & neighbors.

  • You do not have to take their calls.
  • You do not have to answer their questions. It’s too late for Maria, but do not give out personal information. Chances are, Maria is dealing with a junk-debt buyer who purchased this debt for pennies on the dollar, perhaps explaining the new flurry of phone calls and attempts to get Maria to  answer questions—things they should already know. Why do you think the debt collector is asking Maria all these questions? Shouldn’t the DC already have this information? In most cases, they buy packaged debt that’s incomplete. They rely on fear & intimidation to get people like Maria to answer questions and pay.

I don’t know in what state you are in, Maria. In Florida, for instance, the Statute of Limitations on [attempting to ] COLLECT] a debt is 4 years from the date of first delinquency. If this debt is outside SOL, the debt is time-barred, meaning the debt collector still can sue you.

You simply will respond to the summons (suit), proving to the judge the SOL have expired.

Confirm with an attorney specializing in the Fair Debt Collection Practices Act you will not reset (or recast) a debt by making a partial payment or suggesting you will make any type of payment.

  • If the debt collector were to sue you, you can and should demand validation (though legal debt validation applies during the 1st 30 days of receiving the debt collector’s “dunning” letter.
  • Any garnishment and/or jumping into your bank accounts usually occurs on laws for the state in which are you are now living if different from the state in which you signed for the debt, if in fact the debt is yours.
  • If sued, you must respond to the Summons & appear in court (preferably with an attorney representing you--go to www.naca.net for help with a qualified attorney near you). If you choose not to respond to the Summons, the debt collector wins by default and can request an asset/income statement from you for your ability to pay.
